If you specifically save a Torch (Project) as private in CodeTorch, and that Torch has never been public on CodeTorch or anywhere else, the code in that particular Torch is unlicensed.
3.7.1 You agree that this license includes the right for us and other users of the Services to make your Content available to others for the publication, distribution, syndication, or broadcast of such Content on other media and services, subject to our terms and conditions for such Content use. Such additional uses by us or others may be made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Services.
3.8 We may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.
3.9 We reserve the right but am not obligated to monitor all Content and accounts to determine compliance with these Terms. We also have the right to edit, move, or delete any content, without notice.

5.3 If you wish to terminate your account, you may do so by going to your account settings and clicking "Delete Account".
5.4 Any cancellation of your Account will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. This information cannot be recovered from CodeTorch once your Account is cancelled. Please be aware that CodeTorch may for a time retain residual information in our backup and/or archival copies of our database.
6. 3rd Party Websites
6.1 CodeTorch may contain links to third-party websites or services that are not owned or controlled by us. We are not capable of reviewing or managing third party websites, and assumes no responsibility for the privacy practices, content, or functionality of third party websites. You agree to relieve us of any and all liability arising from third party websites.
7. Indemnification
7.1 You agree to defend, indemnify and hold us harmless, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
8. Disclaimer of Warranties
8.1 You acknowledge that you are using CodeTorch at your own risk. CodeTorch is provided "as is," and we hereby expressly disclaim any and all warranties, express and implied, including but not limited to any warranties of accuracy, reliability, title, merchantability, non-infringement, fitness for a particular purpose or any other warranty, condition, guarantee or representation, whether oral, in writing or in electronic form, including but not limited to the accuracy or completeness of any information contained therein or provided by us. Without limiting the foregoing, the we disclaim any and all warranties, express and implied, regarding user-generated content. CodeTorch and its third party service providers do not represent or warrant that access to CodeTorch will be uninterrupted or that there will be no failures, errors or omissions or loss of transmitted information, or that no viruses will be transmitted through CodeTorch services.
9. Limitation of Liability
9.1 In no event shall we be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages of any kind, regardless of the type of claim or the nature of the cause of action, even if we have been advised of the possibility of such damages. Without limiting the foregoing, we shall have no liability to you or any third parties for damages or harms arising out of user-generated content.
10. Jurisdiction
10.1 These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. We make no representation that CodeTorch is appropriate or available for use in other locations. If you access CodeTorch from other locations, you do so at your own risk and are responsible for compliance with local laws.
11. No Waiver
11.1 Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
12. Entire Agreement
12.1 These Terms constitute the entire agreement between you and us regarding the use of the Service, superseding any prior agreements between you and us relating to your use of the Service.
